This is the Privacy Policy (“Privacy Policy”) for the Track ISO website www.TrackISO.com (the “Website”), developed, maintained and operated by Total ISO LLC (together with Total ISO affiliates and subsidiaries, “Total ISO”). In this Privacy Policy, Total ISO use the following terms to describe different types of visitors to Total ISO Website. Total ISO customers are called “Subscribers” (hereinafter defined). Total ISO uses the word “Staff” or “User” (hereinafter further defined and which are included in the definition of Subscriber) to describe persons to whom Subscribers give access to use the Website. For the purpose of this Privacy Policy, any user of the Website shall mean any natural or legal person who accesses or uses the Website either by registering or otherwise. In the event that a natural person is representing a business entity, reference to such terms shall include a reference to the business entity (“Staff”, User”).

This Privacy Policy describes the information that Total ISO collect from Subscriber as part of the normal operation of Total ISO Website and/ or use of Total ISO SaaS based Application and/ or related Web services, how Total ISO collect the information, how Total ISO may use the information and the steps Total ISO take to protect it.

By accepting the Privacy Policy through registration, by visiting and using the Website or by subscribing to or using the Application Subscriber expressly and unconditionally consent to the terms and conditions of this Privacy Policy and consent to Total ISO collection, usage, storage, handling and disclosure of your personal information in accordance with this Privacy Policy. This Privacy Policy is incorporated into and subject to Total ISO Terms of Use.

Privacy and Data protection is a matter of trust and protecting Subscriber’s privacy is of highest importance to Total ISO. Total ISO shall therefore use your name and other information which relates to Subscriber only in the manner set out in this Privacy Policy.

Please read the following Privacy Policy to learn about Total ISO information gathering and dissemination practices that Total ISO follow while using the information provided to Total ISO while using Total ISO Website and/or software. Total ISO Privacy Policy is subject to change at any time without notice. To make sure Subscriber are aware of any changes, please review this Privacy Policy periodically.

  1. APPLICABILITY

This Privacy Policy describes Total ISO policies and procedures on the collection, usage, storage and handling of any information, including business or personal information, provided by Subscriber while using Total ISO Website and/ or Application or its related services.

Use of the Website by Subscriber and/or Application, software and related services will be governed by this Privacy Policy in addition to the Terms of Use as applicable to Subscriber.

  1. COLLECTION AND TOTAL USAGE OF TOTAL ISO’S INFORMATION

When Subscriber uses Total ISO Website, application and/or software, Total ISO collects and stores information which is provided by Subscriber from time to time. “Subscriber Information” is the data submitted by Subscriber that can be used to uniquely identify or contact a person and/ or business entity that a person represents and shall include, but not be limited to, information regarding Subscriber’s title, name, name of the business entity, gender, email address, postal address, delivery address (if different), telephone number, mobile number, fax number, payment details, payment card details or bank account details and such other information required for your identification and verification. By Subscriber submitting its Information on the Website, Subscriber agrees to, and hereby does, grant to Total ISO the right to collect, store, process, handle and use such Subscriber Information, in accordance with this Privacy Policy (as amended from time to time).

Total ISO’s primary goal in doing so is to provide Subscriber a safe, efficient, smooth and customized experience. This allows Total ISO to deliver services in an efficient way, allows Subscriber to access Total ISO products and services that are most likely to meet its needs, and to customize Total ISO Website to make Subscriber’s experience safer and easier. Total ISO as a service provider strictly does not share any information Subscriber keys in and stores in Total ISO servers while using the core application, such as employee information, audit review, audit documentation, compliance, and any other information related to ISO implementation, review, compliance & audit. All such information is stored in Total ISO highly secured servers provided by third parties and can be accessible only by Subscriber, or except as required by statutory authorities and support team of Track ISO in an event requiring access to Subscriber Information with limited rights for troubleshooting.

Information that Total ISO collects from Subscriber is used to process requests and to manage Subscriber’s account. Total ISO may also use Subscriber Information to email Subscriber about Total ISO products or services that Total ISO thinks may be of interest to Subscriber. Total ISO shall not be liable, for any reason whatsoever, for the authenticity of any Subscriber Information provided to Total ISO. Subscriber hereby confirms that the Subscriber Information provided by it is and shall continue to be valid, true and accurate to the best of Subscriber’s knowledge. As such, it shall be the responsibility of the Subscriber to update any changes to the Subscriber Information from time to time.

Subscriber always has the option to not provide information by choosing not to use a particular service or feature on the Website. Total ISO’s use this information provided to us to do internal research on Total ISO users’ demographics, interests, and behavior to better understand, protect and serve Total ISO users.

From time to time Total ISO may send Subscriber Information, excluding bank details, to third parties which Total ISO consider may have goods or services which are of interest to Subscriber. If Subscriber does not wish to be contacted by such third parties please email Total ISO.

Total ISO understand clearly that Subscriber and Subscriber Information is one of Subscriber’s most important assets. Total ISO stores and processes Subscriber’s Information on servers which are located around the world which are protected by physical as well as technological security devices. Total ISO reserve the right to share Subscriber Information with any person or entity, at Total ISO discretion. Total ISO uses third parties to verify and certify Total ISO privacy principles. If Subscriber objects to Subscriber Information being transferred or used in this way do not use the Website.

If Subscriber choose to post messages on Total ISO message boards, chat rooms or other message areas or leave feedback, upload or exchange any content, Total ISO will collect that information Subscriber provide to Total ISO. Total ISO will not be liable for the disclosure and dissemination of information on the Website. Total ISO retain this information as necessary to resolve disputes, provide customer support and troubleshoot problems as permitted by law.

While collecting Subscriber Information, Subscriber’s anonymity is maintained at all times and at no time can Total ISO identify Subscriber personally, unless Subscriber sends Total ISO personal correspondence, such as emails or letters. If other users or third parties send Total ISO correspondence about Subscriber’s activities or postings on the Website, Total ISO may collect such information into a file specific to Subscriber. Total ISO products are web–enabled. Subscriber can access some of Total ISO services from within Total ISO desktop products and others directly at a Website. Some desktop features require Internet access and will open in a browser window in the software, which will pass through Total ISO Website’s server before being redirected onto the Internet. If the software cannot find a connection, it may ask Subscriber to establish one. When Subscriber are connected to the Internet from within the software Total ISO may also include product updates and messages, service information and help content in the Internet transmissions.

If Subscriber uses Total ISO’s Mobile App, the Mobile App can check Total ISO servers for automatic Updates. The Mobile App will automatically check for updates when Subscriber is connected to Total ISO servers. Subscriber can also download updates manually from app store of respective operating systems i.e. Windows Store for Windows, Play Store for Android and Apple Store for iOS devises. When Subscriber receives updates, Total ISO will receive technical information about Subscriber’s mobile connection and the software being updated. When Subscriber accesses Total ISO web–enabled services from within Total ISO desktop products, Total ISO will note the link Subscriber clicked on and Total ISO may also collect information about Subscriber’s product, system or other technical data that will help Total ISO direct Subscriber to the appropriate information or service. Some of Total ISO web–enabled products and services synchronize with the information on Subscriber’s computer to help keep the data accurate and provide additional online services. If Subscriber no longer wants to synchronize data, Subscriber can cancel the service through the service administration pages.

Total ISO uses Subscriber’s activity on the Website to assist Subscriber by reducing the need to improve its user experience, re–enter its data and to help Total ISO resolve technical support issues. Total ISO may also use this information to offer Subscriber a personalized web experience, and to tailor Total ISO offerings to Subscriber.

  1. SHARING OF PERSONAL INFORMATION

Total ISO do not share Subscriber Information outside of Total ISO except in cases requiring Total ISO to continue to provide Subscriber expected service levels. Total ISO may need to disclose Subscriber Information (1) to Total ISO affiliates, service providers and business partners solely for the purpose of providing ISO Services to Subscriber as per Total ISO Terms of Services (2) to facilitate the purchase of Services on the Website or through Total ISO software by Subscriber for which Total ISO will be using third party payment gateways and subscription software. The Subscriber Information will be saved in server logs through highly robust Customer Relationship Management (CRM) software where the Subscriber data would be stored and/or processed. Subscribers need to agree to this. Credit card information would be stored only in places which are “PCI DSS” certified and will be used for processing recurring billings. In such cases Total ISO will also ensure that such affiliates, service providers and business partners comply with this Privacy Policy Statement and adopt appropriate confidentiality and security measures.

Except as provided above, Total ISO shall disclose the Subscriber Information only in circumstances where:

(1) Total ISO have obtained Subscriber’s prior specific consent before sharing or disclosing Subscriber Information to third parties for any purpose that is not directly connected with providing ISO Services to Subscriber as mentioned above. Those entities and affiliates may not market to Subscriber as a result of such sharing unless Subscriber explicitly opt-in.

(2) Total ISO in good faith believe that access, use, preservation or disclosure of such information is reasonably necessary to (a) satisfy any applicable law, regulation, legal process or enforceable governmental or regulatory request; (b) enforce the Terms of use or this Privacy Policy; (c) detect, prevent, or otherwise address fraud, security or technical issues; (d) facilitate the purchase/ sale of products and services; or (e) protect against imminent harm to the rights, property or safety of the Total ISO, its users or the public as required or permitted by law.

(3) Total ISO and Total ISO affiliates may also share with or transfer to another business entity some or all of Subscriber’s Information, in the event of merger or acquisition with, or being acquired by that business entity, or re-organization, amalgamation, restructuring of business or sale (including any transfers made as a part of an insolvency or bankruptcy proceeding). Pursuant to the consummation of such transaction, the new business entity (or the new combined entity) will be required to follow this Privacy Policy with respect to Subscriber’s personal information.

Total ISO may also send Subscriber other information about Total ISO, the discount offers, Total ISO other websites, sales promotions, Total ISO newsletters, SMS updates, anything relating to other companies. If Subscriber would prefer not to receive any of this additional information as detailed in this paragraph (or any part of it) please click the “unsubscribe” link in any email that Total ISO send to Subscriber or follow the un-subscription process as detailed in the SMS. Kindly note that unsubscribing from one medium does not automatically lead to un-subscription from the other. Within 7 working days (days which are not (i) a Saturday or Sunday, or (ii) a public holiday anywhere in the USA) of receipt of Subscriber’s instruction, Total ISO will cease to send Subscriber information as requested. If Subscriber’s instruction is unclear Total ISO will contact Subscriber for clarification.

  1. LINKS TO THIRD PARTY SITES AND ADVERTISEMENT

Total ISO may also share Subscriber’s details with Total ISO agents and subcontractors to help Total ISO with any of Total ISO’s uses of Subscriber Information as set out in this Privacy Policy. Total ISO may use third parties to assist Total ISO with delivering products to Subscriber, to analyze data and to provide Total ISO with marketing or customer service assistance. Total ISO may exchange information with third parties for the purposes of fraud protection and credit risk reduction.

The Website may contain advertising of third parties and links to other sites or frames of other sites. Please be aware that Total ISO are not responsible for the privacy practices or content of those third parties or other sites, nor for any third party to whom Total ISO transfer Subscriber data in accordance with Total ISO Privacy Policy.

  1. SECURITY PRECAUTIONS

Total ISO uses industry appropriate data collection, storage and processing practices and reasonable physical, electronic and managerial procedures to safeguard and secure the Subscriber Information collected. Total ISO’s Website has stringent security measures in place to prevent loss, misuse, unlawful interception and alteration of the Subscriber Information under Total ISO control in compliance with the applicable laws and rules related thereto. Whenever Subscriber changes or accesses its account information, Total ISO offers the use of a secure server. Once Subscriber Information is in Total ISO’s possession Total ISO adheres to strict security guidelines, protecting it against unauthorized access.

However, as Subscriber is aware, no internet site is completely free of security risks and Total ISO does not make any representation in respect of the same. Total ISO shall not be liable, in case for any security breach of Subscriber Information and Subscriber agrees that it shall not have or make any claims against Total ISO in this regard. Total ISO uses standard and authorized payment services and Total ISO Credit Check and Fraud Prevention policies are aligned to these companies.

Total ISO does not warrant that Total ISO Website or any electronic communication made by Total ISO is free from virus or other harmful effects. In the event of any errors in transmission or due to an act of a third party, Total ISO shall have no liability. Subscriber explicitly agrees that its use of the Website and/ or software and/ or services is at its own risk. Subscriber agrees and confirms that Subscriber Information may be transferred, processed and stored across National and International borders. Subscriber hereby confirms that Subscriber has been made aware of the security measures undertaken by Total ISO and Subscriber expressly consents to Total ISO storing, handling, using Subscriber Information in accordance with this Privacy Policy, including but not limited to Subscriber’s consent for sharing Subscriber Information as per this Privacy Policy.

  1. CHANGES IN PRIVACY POLICY

If Total ISO decides to change Total ISO policy, Total ISO will post those changes on this page in order to keep Subscriber informed of any changes in nature of information collected, manner of collection, use and sharing of information. These changes will become effective immediately on posting. If at any point Total ISO decide to use Personal Information in a manner different from that stated at the time it was collected, Total ISO will notify Subscriber by email and provide Subscriber with the ability to opt out of these new uses. Subscriber will not receive email notification of minor changes to the Privacy Policy. If Subscriber is concerned about how its Personal Information is used, Subscriber can send Total ISO an email detailing its concern. Subscriber is required to visit the Privacy Policy page regularly for any amendment thereto, which may or may not affect Subscriber. Total ISO shall not be liable for any failure or negligence on Subscriber’s part to review the updated Privacy Policy before accessing or availing the services on the Website and/ or software. Subscriber’s continued use of the Website and/ or services, following the changes to the Privacy Policy, will constitute Subscriber’s acceptance to those changes.

  1. COOKIES

Subscriber’s web browser offers “cookies” which, if Subscriber allows their use, store small amounts of data on its own computer when Subscriber visits a website. Cookies do not contain any Personal Information about Subscriber and therefore cannot be used to identify Subscriber personally. However, cookies assist Total ISO in tracking which of Total ISO features Subscriber like best. Using cookies will be storing information in the client’s browser using local storage or web storage. Therefore, cookies enable Total ISO to customize Total ISO content according to Subscriber’s preferences. Subscriber has the ability to accept or decline cookies by modifying its browser settings. The Website is viewable even if Subscriber disables the cookie function on its browser. However, if Subscriber disables cookies, some advanced and customized features will not be available to Subscriber.

Total ISO also automatically tracks certain information about Subscriber based upon Subscriber’s behavior on the Website and stores it through log files. Total ISO uses this information to do internal research on Total ISO users’ demographics, interests, and behavior to better understand, protect and serve Subscriber and Total ISO community. This information may include the URL that Subscriber just came from, which URL Subscriber next goes to, Subscriber’s computer browser information and IP address. Total ISO may provide customers’ IP addresses to payment intermediaries in the course of the payment process.

Technologies such as: cookies, beacons, tags and scripts are used by Track ISO and Total ISO partners (e.g., advertising, marketing and analytics), affiliates, or other service providers. These technologies are used in analyzing trends, administering the site, tracking users’ movements around the site and to gather demographic information about Total ISO user base as a whole. Total ISO may receive reports based on the use of these technologies by these companies on an individual as well as aggregated basis.

Total ISO uses cookies to remember users’ settings, store login addresses, authenticate users, run website experiments, and store analytics data. Users can control the use of cookies at the individual browser level. If Subscriber rejects cookies, Subscriber may still use the Total ISO site, but its ability to use some features or areas of the Total ISO site may be limited.

Total ISO and third parties with whom Total ISO partner to provide certain features on the Total ISO site or to display advertising based upon Subscriber’s web browsing activity use Local Storage Objects (LSOs) such as HTML 5 to collect and store information. Various browsers may offer their own management tools for removing HTML5 LSOs.

Total ISO partner with third party(ies) to either display advertising on the Website or to manage Total ISO advertising on other sites. Total ISO third party partner(s) may use technologies such as cookies to gather information about Subscriber activities on this site and other sites in order to provide Subscriber advertising based upon its browsing activities and interests. If Subscriber wishes to not have this information used for the purpose of serving Subscriber interest-based ads, Subscriber may opt-out by clicking here. Please note this does not opt Subscriber out of receiving ads. Subscriber will continue to receive generic ads. Total ISO does not control the use of cookies by third parties and shall not be liable for any reason whatsoever of these third party cookies.

  1. FORCE MAJEURE

Notwithstanding anything contained in this Privacy Policy, the Terms of Use or elsewhere, Total ISO shall not be held responsible for any loss, damage or misuse of Subscriber Information, if such loss, damage or misuse is attributable to a Force Majeure Event. A “Force Majeure Event” shall mean any event that is beyond the reasonable control of Total ISO and shall include, without limitation, sabotage, fire, flood, explosion, acts of God, civil commotion, acts of terrorism, strikes or industrial action of any kind, riots, insurrection, war, acts of government, computer hacking, technical snags, unauthorized access to computer data and storage device, technical snags or breach of security and encryption.

  1. DISCLOSURES REQUIRED BY LAW

The Total ISO reserves the right to disclose Subscriber Information when required by law. Total ISO will disclose such Subscriber Information when Total ISO has a good-faith belief that it is necessary to comply with a court order, ongoing judicial proceeding, or other legal process served on Total ISO or to exercise Total ISO’s legal rights or defend against legal claims.
